The Civil and Canonical Rights of Roman Catholic Priests in Boston

Dear Fr. Erikson:

Today, February 2, 2010, I accompanied Fr. *** to the Chancery where, as you know, he had been summoned to a meeting by Mr. Mark Dunderdale and Rev. Tom Foley from the Office of "Professional Standards and Oversight".

According to Fr. Foley, Cardinal O'Malley had instructed Mr. Dunderdale and Rev. Foley to "review the history" of Father's personnel file to "ask certain questions". Due to the strangeness of the request, and other meetings conducted with priests that ended in the demise, disappearances and incarcerations in lock-down facilities outside of constitutional, civil and canonical rights of the priests, several of Fr. ***'s supporters and advisers wanted a lay representative present.

Though Fr. **** released the diocese from any privacy violations my presence would compromise, Mr. Dunderdale explained to me I would not be permitted to attend because of privacy concerns as he intended to review Father's personnel file.

Hard to make sense out of this reasoning, in light of the fact the diocese had already publicly released Fr. ***'s personnel file (which I have repeatedly and intimately examined over the years) and the diocese telling the Boston Globe of the Cardinal's intentions to release names and addresses of "credibly accused" without any substantive or factual information. In fact, the accused is forbidden by the diocese to give out substantive factual information that would vindicate him. The diocese, even upon the request of a civilly and canonically vindicated priest, has thus far refused to permit the priest to release information pertaining to his innocence.

Concerns about protecting "privacy" are certainly moot.

I'm trying to understand what is happening to our priests' civil rights.

Can you help me to understand what this process is?

Imagine yourself an IT tech civilly employed, accused of sexual abuse by a complainant. Imagine those accusations investigated by the police, the DA and found to be incoherent, physically and factually impossible. Imagine the allegation being further investigated by your civil employer, vindicated and cleared to work. Imagine your employer a few years later, without any cause, dusting off the same old file with the same old allegation and asking you to go through another employee investigation to be cleared to work. Imagine being vindicated a second time.

Now, imagine the CEO of your IT company ten years later hiring a former District Attorney. Imagine yourself being summoned,, without cause, to the office of 'professional standards and oversight' where this former district attorney tells you he's been charged by the CEO (which in this case is the Cardinal) to "review your file history".

I can't think of a single precedent where an employer could withstand the scrutiny of civil and constitutional law in a free country.

Of course, it is quite possible, Catholic priests and the Catholic Church are no longer free in this country.

If the civil and constitutional rights of our priests and the Catholic Church have been stripped, this is not something that will be done under the cover of darkness and secrecy.

What is a former district attorney doing digging out old files out of the cobwebs and conducting inquisitions upon priests who have been vindicated?

Laity has a right to know because we have a right to send our sons and grandsons into vocations of Roman Catholic Church with all the freedoms every citizen enjoys.

Catholics can and should be prosecuted by civil law if warranted.

With all due respect to Mr. Dunderdale, the Cardinal doesn't have the authority to set up kangaroo inquisitions or incarcerate priests in lock down facilities outside of civil law. Nor are employers permitted to hire district attorneys to open up private investigations about civil matters that have been resolved.


I have had an extended conversation with Anne Barret Doyle of Bishops Accountability and expressed to her my ongoing concerns that the Cardinal has no process to determine the "credibility" of the complaint. We seem to have some agreement that the RCAB seems to have ignored civil and canonical laws at the whim of corporate need at any given moment as they perceived it. I raised objections to releasing names under the impression there were "credible" accusations against the (any) priest.
"Credible" implies there was evidence to substantiate the accusation. It implies there was unbiased witness substantiation. It implies there was an investigation whereby a determination was made that there was enough evidence to determine the likelihood that the accuser's story most likely happened.

I wanted to assure everyone that Fr. X was represented by a spectacular Canon lawyer. And, though a civil lawyer was not part of this weeks kangaroo inquisition, rest assured everyone following Cardinal O'Malley is keenly aware his invitation to permit the government of the United States to be seated inside of a Chancery to indict, convict and incarcerate accused outside of civil and constitutional law has got to be vigorously opposed.

I don't think anyone opposes the diocese releasing names of "credibly accused".


The Cardinal bears the burden of defining "credibly accused".

"Credibly accused" doesn't include accusations where the police and/or the district attorney didn't find the accuser and/or their story "credible".

As a concerned Boston Catholic, I can see some solid, orthodox priests losing heart over some events in the Archdiocese. Certainly we need to pray more for them. Carol, any practical ideas on other action we could take to support these good men?

GIO - We've been trying to do this for years. Ever hear the old saying "You can't fight City Hall"?

What IS going on in the Archdiocese of Boston??? And Fr. Benedict Groeschel brags about Cardinal O'Mally being such a good friend of his?

There's something or someone else orchestrating all of this but I'll be darned if I know.

Boston (the entire Church for that matter) has my poor, pitiful prayers.

Are there any people upset that innccent priests are being denied the respect and rights deserved by their citizenship and years of faith-filled service?

Do you you not believe that false accusers should be prosecuted?

Those who know are plenty upset.

This is a fight our priests can't fight.
It is up to laity to step forward. Many are, more will be needed. The direction at this juncture is not clear. Right now is the time to simply expose what is going on inside of the Boston Chancery when a false accusation is made.

I have more to post about this priest's history that proves his innocence and the actions of the diocese.

Like Judas who incriminated the innocent, this accuser is suicidal, erratic and mentally stable. You can't do something this vile to another human being without guilt destroying you. I do believe the diocese has an obligation to help set free the evil that eats up both the false accuser and the accused.

Right now, they are no more interested in the souls involved than they are safety of the unborn children they hired to kill them at Caritas.

I believe there are many people trapped at the Chancery carrying out orders of the cowardly and the few who are sadly even corrupt.

We don't know where the Holy Spirit is leading. We only know it is time to step up to the plate and release the information. No agenda except for this at the present.

Spreading the word right now is the best thing we can do.

Carol,I just read your magnificient post and would like to offer some thoughts and suggestions. Thank you for letting me do so. I have written rather extensively on this issue, and have learned a few things along the way. First, "credible" often means that a mediated financial settlement has been reached. This serves the purposes of the diocese by making the case go away, but it places the accused priest in great jeopardy. A bishop will NEVER admit to settling an accusation that he did not find to be credible. Therefore all settled accusations are "credible."

Let me describe the standard under which many of these claims are settled. Former Boston Auxiliary Bishop John McCormack in 2002 entered into multimillion dollar settlement agreements with Peter Hutchins, a local contingency lawyer. Hutchins, in a seeming attempt to lure new clients for another wave, told the local New Hampshire newspapers, "The Diocese wasn't interested in details such as when abuse occurred or even where. I've never seen anything like it." This is the standard of typical diocesan "investigation" of allegations against accused priests. The fact is, and everyone knows it, there is no process known to exist by which a 30 or 40 year old sex abuse claim, barring DNA evidence, could be determined to be credible or not. Just to the north of you in the Diocese of Manchester the practices are no different, and just as dubious. It is for this reason that Bill Donahue, president of the Catholic League for Religious and Civil Rights, has declared "There is no one in the United States with less civil liberties protection than the average American Catholic priest."

This seems to be perfectly OK with Anne Barrett Doyle and Voice of the "Faithful." It is not OK with those of us who are now questioning what is happening to our priests who disappear in the dark of night. I urge you and your readers to do two things. First, please go to www.TheseStoneWalls.com and explore the case of one imprisoned priest, falsely accused, who has decided not to go quietly into the night. Then I urge you and your readers to go to www.PriestsinCrisis.com and read "The Dark Night of a Priestly Soul." It is a document that should be read by every Catholic before another priest is accused and hung out to dry. It is time for a revolution of our own and for the voices of the real faithful, and just, to be heard.

Thank you for your informative post and support.

In a way, you've filled in several pieces of the puzzle. It makes perfect sense that once the diocese gives money to a false accuser, they would not want evidence of the priest's innocence out in the public square.

I'm catching up on Fr. MacRae's story, which I'm very grateful you linked to. Reading the crucible is hard in so many ways. The events are so twisted in these stories, the imprimatur of the devil is crystal clear. It's really so bizarre, it couldn't possibly be of human origin. The serpent is using unstable people to attack the priesthood and the Church.

I will also say that my jaw dropped when I read that Catholic Charities is involved in this case. Their fingerprints are all over things here in Boston.

My name sake, Giordano Bruno suffered the righteousness of the Church in its worse form ... we are there yet again !
I continue to suffer the harasment of my bishop and his "not so holy lackies" ... I know I am not alone ...
My brother priests have been crushed and intimidation has them muzzled ... the Laity too remains too quiet ... as I too may climb the scaffold steps ... my prayers will be for the remnant faithful like you, Ryan, Carol, Chris and
'City Hall" ... PLEASE DON'T GIVE UP ! Your yet small voice will be heard by the Almighty who will eventually right all the wrongs of the CORPORATE CHURCH of the Eminent Sean and his cronies.

Dunderdale sounds like a guy who in the past has done valuable work but these two articles make clear he is setting up his own judicial system inside of the offices of an employer and will be trying cases.


Carol, There is no time to waste. Contact a civil/constitutional lawyer. It is critical you obtain a lawyer who is a non-Catholic.

Get Fr. Gio's experience along with these two articles before all ecclesiastical authorities in Rome. I would also encourage you to file a complaint with the Board of Bar Overseers about the constitutional violations.

You must act quickly.

Put up a comprehensive blog post about the ordeal that includes the experience and response from the priest you accompanies and circulate it.

There isn't a thing I disagree with in this article and I wholeheartedly and zealously support it's premises.

Exposing how falsely accused priests are now being victimized by the Church is a critical part of the process.

Exchanging one type of victim for another without uprooting the corrupt continues to be scandalous.

Here are some stats for you and your readers: 7000+ priests in the United States have been accused; between 64 to 89 priests have been incarcerated 5 years or more; between 29 to 35 priests accused committed suicide, 1/3rd of them before there was any kind of investigation!
If these stats are even partially correct, we are facing an epidemic of Bibical proportion! And if spiritual history follows form, then the call to justice will fall again to lay leadership. Perhaps the Lord will raise up among those accused a congregation, brotherhood or order to change the perceptions of the heirarchy, along with the laity. Perhaps the laity will vote with their wallets and or feet. But through it all, the shortest sentence in the New Testament, "And Jesus wept." will again be its rallying cry.
